Residency in Costa Rica for investors and retirees

Purchasing real estate and securing residency approval in Costa Rica are distinct processes. While an investment may serve as the basis for a specific residency category, it does not guarantee approval. The frequently cited figure of USD 150,000 must be interpreted within the context of the relevant regulations and the currently applicable application criteria, rather than as an automatic residency card granted for the purchase price.

What the verified 2023 regulation states

Decree No. 43926-MGP-H-TUR, published on 23 February 2023, governs applications based on a qualifying investment of at least USD 150,000. It sets out various types of investment and the requirements for evidencing them. This historically documented framework is not presented in this article as an automatically guaranteed condition for every new application in October 2026.

Law No. 9996 also contains time-limited incentives. The validity or potential extension of these incentives must not be conflated with the overall immigration regime. The current status for a new applicant and the available concessions must be confirmed by the DGME and a qualified immigration lawyer.

The purchase price may not constitute a qualifying investment

For the real estate route, the 2023 regulation requires the applicant's registered ownership alongside documentation of municipal registered value and tax compliance status. In the case of a financed purchase, it addresses the required equity investment. Consequently, a property priced at USD 150,000 paid predominantly via a loan cannot automatically be considered to satisfy the threshold.

For real estate, the required proof of value may differ from the figure stated in a sales brochure. Before signing, ascertain which valuations and supporting documents will be accepted. It is ill-advised to purchase solely for residency purposes and address the documentation only after payment has been made.

Personal title and a corporate entity are not interchangeable

The regulation for the direct real estate pathway explicitly distinguishes ownership held directly by the applicant from assets owned by a legal entity. An equity investment in an active company requires different documentation. A passive company holding a house does not automatically satisfy this alternative.

Therefore, evaluate the ownership structure alongside your residency plan, taxes, and estate planning. A structure that may be convenient for co-owners could prove unsuitable for the intended application. Any recommendation should be in writing and tailored to your specific circumstances.

An application is not merely a real estate deed

The DGME publishes general requirements for initial applications, including identification, birth certificates, and police clearance records, alongside their required legalisation. Verify the requirements for apostilles, certified translations, and document validity periods for your chosen category.

  • Applicable category and current legal requirements.
  • The precise method of proving ownership and investment value.
  • Personal documentation, its legalisation, and translations.
  • Obligations associated with renewal and maintaining the investment.
  • Implications for the healthcare system, residency, and tax residence.

Rentista, pensionado, and investor cater to different circumstances

Categories linked to income or pensions are not the same as investment-based categories. This article does not state unverified current thresholds or processing timeframes. Legal counsel should evaluate your specific income, assets, dependants, and realistic plans for living in the country.

Residency status and tax residence are also entirely separate matters. The notion that a residency card automatically resolves Czech tax liabilities or all work permissions is incorrect. Each of these matters warrants independent assessment.

A prudent sequence for decision-making

First, obtain confirmation of the currently available category and investment qualification, then select the ownership structure, and only then proceed to the purchase agreement. If the property makes no sense without the residency benefit, this dependency must be resolved prior to any non-refundable payment. Never treat a purchase as a guarantee of an immigration authority approval.
