Playas del Coco and Papagayo: close to airport and sea

Playas del Coco and the Papagayo area belong to the northern sector of the Guanacaste tourism region. For a buyer, however, they represent neither the same product nor automatically the same legal regime. The deciding factors are the specific unit, access to utilities and services, rental regulations, and whether you are purchasing freehold ownership or rights within a concession structure.

The town, the gulf, and the project are not the same thing

The official ICT lists El Coco and Papagayo among the region's tourist hubs. When evaluating a listing, however, request the exact address and cadastral parcel. The commercial use of the Papagayo name alone does not prove that a property lies within a specific resort or is subject to a specific concession.

In Coco, an investor may compare an apartment in a communal development, a detached house, and a hillside plot. These are fundamentally different operating models. Access to a swimming pool and landscaped gardens may be funded through communal service charges; a private home requires its own independent contractors.

When buying an apartment, scrutinise the entire condominium

The development's rules will govern length of stay, guest access, parking, noise, and interior alterations. An estate agent's verbal assurance regarding Airbnb suitability is no substitute for complete, legally valid documentation and an independent operational assessment.

  • Bylaws and community rules, including amendments and rental restrictions.
  • Operating budget, unit arrears, and reserve funds for repairs.
  • Minutes of general meetings and scheduled special assessments.
  • Physical condition of communal roofs, swimming pools, and pumps.
  • Precise legal title regarding parking, storage, and common areas.

An ocean view is not walkable beach access

A view can be a valuable feature, but it reveals nothing about road gradients, transport links, or evening access. Verify the route both on foot and by car, and confirm that the marketed view corresponds to the specific floor being purchased, rather than another unit.

On hillside terrain, you require an assessment of drainage, slope stability, and access infrastructure costs. Neighbouring future construction can alter the view; do not rely on the assumption of a permanent panorama without reviewing the building potential of adjacent parcels.

Papagayo may require specialised legal analysis

The Golfo de Papagayo Tourist Development Project operates under a specific legal framework governed by Law No. 6758. One cannot mechanically treat all listings in the wider area as standard coastal title or an ordinary concession under a different regime.

Legal counsel must identify the subject of acquisition, duration and terms of rights, transfer approvals, concession fees, and mandatory operational programmes. Club memberships, resort amenities, or fit-out specifications carry their own cost structures. Determine whether they are mandatory and how their pricing may change over time.

How to compare two listings

Establish the total acquisition cost and annual operating budget for each unit. Compare owner usage, management commissions, mandatory property management, communal charges, and the actual scope of amenities. A higher nightly rate does not necessarily translate into a higher net yield.

For new-build properties, distinguish the legally and structurally verified status from marketing renders. Enquire whether promised amenities will be completed prior to the handover of your unit, and what contractual protections apply if completion dates change.

Checklist questions for a viewing

  • What legal title will I acquire, and what is required to execute its transfer?
  • Which services and fees are mandatory?
  • Do the view and floor plan genuinely belong to this specific unit?
  • Can I appoint my own property manager and use the apartment according to my own schedule?
  • What repairs and capital contributions are currently being planned across the development?
